What Is DUI?
A DUI or driving under the influence offense is when a person driving or is in physical control of the vehicle is under the influence of alcoholic beverage, unlawful chemical substances, or controlled substances that can subsequently affect the individual’s normal capabilities to operate a vehicle without being impaired.
Typically, a DUI results when a person has a blood alcohol level of 0.08 or more grams of alcohol per 100 milliliters of blood or a breath alcohol level of 0.08 or more grams of alcohol per 210 liters of breath.
How Can You Fight a DUI Charge in Florida?
Most of the evidence used in a DUI case can be subjective. With the right criminal lawyer on your side, we can pose many different challenges to the evidence attained. The defenses used by your attorney can play a major role in the outcome of your case.
- Lack of Probable Cause
- Challenge of the Validity of the Field Test
- Lack of Actual Physical Control
A law enforcement official should have probable cause for the traffic stop. They must be able to state that you were violating some form of traffic law whether it’s running a stop sign or red light, speeding and driving erratically. Your attorney can fight that an officer did not have any of these suspicions present, consequently arguing to suppress the evidence received during the stop.
Sometimes the accuracy of a breathalyzer can be challenged. Based on the way it was administered, the calibration of the device, or even a medical condition that the driver may have can lead to false positives. Even the nature of field sobriety test can be challenged as the outcome is mostly subjective and there could be other underlying factors that could affect an individual’s performance during the test.
In some cases, your attorney can also argue that you did not have actual physical control of the vehicle during the time of the stop. It must be successfully proven that the defendant was in physical control of the vehicle in order for them to actually be charged with a DUI offense.
